AZ Charged is a curated directory: we research and select the businesses we list, and no business can pay for a better position. Our listings and guides are informational recommendations, not guarantees — you hire businesses at your own judgment, and your agreements with them are between you and them. Businesses that list with us pay a fee for the listing, not for rank, and we reserve the right to remove any listing that stops meeting our standards. The details follow.
These Terms & Conditions ("Terms") govern your use of azcharged.com (the "Site"), operated by AZ Charged ("we," "us," "our"). By accessing the Site, submitting a business for listing, or purchasing a listing, you agree to these Terms. If you don't agree, don't use the Site.
1. What AZ Charged Is (and Isn't)
AZ Charged is an independently operated Arizona business directory and publisher of Arizona-focused guides. We research, select, and feature businesses based on our own editorial judgment and vetting criteria. We are not a party to any transaction between you and a listed business, we are not an agent, broker, or referral service for any listed business, and we do not supervise, control, or warrant the work any listed business performs.
2. Recommendations Are Not Guarantees
We stand behind our vetting process, but a listing, ranking, "best of" inclusion, or editorial recommendation on this Site is an informational opinion based on the information available to us at the time — it is not a warranty, endorsement of future performance, or guarantee of any business's licensing status, insurance, pricing, availability, or quality of work. Conditions change: businesses change ownership, lose licenses, and decline in quality after we review them.
Before hiring any business, verify current licensing, insurance, and references yourself. For contractors, verify license status directly with the Arizona Registrar of Contractors. Any dispute arising from your engagement of a listed business is solely between you and that business.
3. Business Listing Terms
If you purchase a listing on AZ Charged, the following applies:
4. Information You Submit
When you submit business information, photos, logos, descriptions, or other content for a listing or feature, you represent and warrant that: (a) the information is truthful and accurate, including licensing and certification claims; (b) you own the content or have the right to provide it; and (c) it doesn't infringe anyone's rights. You grant AZ Charged a non-exclusive, royalty-free license to use, display, reproduce, and adapt that content on the Site and in our marketing of the Site (including social media) for as long as your listing is active and for a reasonable period afterward in archived content.
You are responsible for keeping your listing information current. Misrepresenting licensing, insurance, reviews, or credentials is grounds for immediate removal without refund.
5. Our Editorial & Removal Rights
The credibility of this directory depends on our independence, so we retain full editorial control at all times. We may, at our sole discretion and without liability: decline any listing application; edit listing content for accuracy, clarity, or style; re-review any listed business at any time; and suspend or remove any listing — including for loss of licensure, a pattern of credible customer complaints, misrepresentation, non-payment, or any conduct we believe is inconsistent with the standards of the directory. If we remove a listing mid-cycle for a Terms violation, fees paid are not refunded. If we remove a listing mid-cycle for reasons other than a violation, we'll refund the unused portion of that month.
6. Acceptable Use of the Site
You agree not to:
- Scrape, harvest, or systematically copy Site content or listing data, including for training or populating competing directories or datasets
- Submit false, deceptive, or infringing content, or impersonate any business or person
- Interfere with the Site's operation, security, or availability
- Use the Site for any unlawful purpose
7. Our Content & Intellectual Property
All Site content we create — guides, reviews, rankings, comparison tables, graphics, and the AZ Charged name, logo, and "Arizona's Business Energy" tagline — is owned by AZ Charged and protected by copyright and trademark law. You may share links to our pages freely (please do). You may not republish substantial portions of our content without written permission. Listed businesses may reference their inclusion on AZ Charged ("Featured on AZ Charged") in their own marketing while their listing is active.
8. Third-Party Websites
The Site links to third-party websites, including listed businesses' own sites. We don't control those sites and aren't responsible for their content, accuracy, or practices. Our Privacy Policy stops applying the moment you leave azcharged.com.
9. Disclaimers & Limitation of Liability
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY ARIZONA LAW, AZ CHARGED WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING DAMAGES ARISING FROM YOUR ENGAGEMENT OF, OR RELIANCE ON INFORMATION ABOUT, ANY LISTED BUSINESS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR A LISTING WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED DOLLARS ($100) IF YOU PAID US NOTHING.
10. Indemnification
If you're a listed business, you agree to defend, indemnify, and hold harmless AZ Charged from any claims, damages, and expenses (including reasonable attorneys' fees) arising from the content you submit, your services or products, your dealings with customers, or your breach of these Terms.
11. Governing Law & Disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to that venue.
12. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted here, with the "Last updated" date revised. For active listing customers, material changes to listing terms will be communicated by email before they take effect. Continued use of the Site after changes means you accept them.
